Terms of Service

1. Agreement to These Terms

Futures Trading Revolution is a business name of Fundamental Futures, a sole proprietorship owned and operated by Jason Niehoff ("FTR," "we," "us," or "our"). These Terms of Service ("Terms") govern your purchase and use of our products and services, including FTR Private Coaching, the FTR curriculum, the Daily Futures Playbook, our NinjaTrader indicators, and any related content, calls, or communities (together, the "Services"), whether accessed through Whop or any other platform.

By purchasing, accessing, or using the Services, you agree to these Terms, our Privacy Policy, our Return Policy, and our End User License Agreement (EULA). If you do not agree, do not purchase or use the Services.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to purchase or use the Services. You are responsible for complying with all laws and regulations that apply to you, including any rules governing trading in your country of residence.

3. Educational Purpose Only; No Financial Advice

All Services are educational in nature. Nothing we provide, including coaching calls, group calls, curriculum, market analysis, charts, levels, directional bias, indicators, or messages, is financial, investment, tax, or legal advice, or a recommendation to buy or sell any security or futures contract.

Jason Niehoff and FTR are not registered investment advisers, commodity trading advisors, or broker-dealers. You are solely responsible for every trading decision you make and for the results of those decisions.

4. Risk Disclosure

Futures trading involves substantial risk and is not suitable for every investor. You could lose all of, or more than, your initial investment. Only risk capital, meaning money you can afford to lose without affecting your financial security or lifestyle, should be used for trading. Past performance is not indicative of future results. Hypothetical and simulated results have inherent limitations, are prepared with the benefit of hindsight, and do not involve financial risk. Trades shown in lessons, classes, the Daily Futures Playbook, or any live session should be considered hypothetical and are for educational purposes only.

5. No Guarantee of Results

We do not guarantee any level of income, profit, account growth, or trading success. Testimonials and student experiences are individual results, may not be representative of other clients, and are not a guarantee of future performance. Your results depend on many factors outside our control, including your effort, discipline, capital, risk management, and market conditions.

6. Services and Program Term

FTR Private Coaching is a 6-month program. Unless the product page states otherwise, it includes one-on-one coaching calls every two weeks, a weekly group coaching call with replays, text and voice coaching through Voxer, access to the FTR curriculum, homework and trade reviews, the Daily Futures Playbook, and access to our private community.

The program term begins on the date access is granted. Calls are scheduled at mutually available times. If you need to reschedule a call, let us know in advance and we will work with you to find a new time. A call you miss without notice is forfeited and will not be rescheduled or carried over. Voxer text and voice coaching is available 24/7, and Jason aims to respond within 24 hours of receiving your message. We may update the format, platforms, or content of the Services to improve them, provided the core value of what you purchased is not materially reduced.

Access to program components, including community and call access, ends when your program term ends unless you renew or we state otherwise in writing.

7. Payments

Payments are processed by Whop or another third-party payment processor. By purchasing, you authorize the processor to charge the payment method you provide for the full price and any applicable taxes.

If you choose a payment plan, you are agreeing to pay the full program price. Every scheduled installment remains due even if you stop participating, stop attending, or stop using the Services. If a payment fails, we may suspend your access until the balance is paid.

8. Refunds

All sales are final once access to the Services has been granted. Please see our Return Policy for full details.

9. Chargebacks

If you believe a charge is in error, contact us first at support@futurestradingrevolution.com so we can resolve it. Filing a chargeback or payment dispute for a purchase you authorized, after receiving access, is a breach of these Terms. We may suspend or terminate your access and provide evidence of your purchase and use of the Services to the payment processor.

10. Intellectual Property

All content in the Services, including videos, curriculum, the names of our trade setups, written materials, charts, templates, indicators, and recordings, is owned by FTR or its licensors and is protected by copyright and other laws. Your use of that content is governed by our EULA. You may not copy, share, resell, record, or distribute any part of the Services without our written permission.

11. Community and Conduct

You agree to treat other members and our team respectfully. You may not harass others, post unlawful or misleading content, promote other products or services without permission, share other members' personal information, or share login credentials. We may remove content or suspend or terminate access, without refund, for violations of these Terms.

12. Recordings and Testimonials

Group calls may be recorded and made available to other members as replays. One-on-one calls may be recorded for your benefit and for quality purposes. We will not publish your one-on-one recordings, your name, or your likeness in marketing without your separate permission.

13. Third-Party Services

The Services rely on third-party platforms such as Whop, Kajabi, NinjaTrader, Zoom, Calendly, Wistia, Voxer, messaging apps, and journaling software. We are not responsible for the availability, accuracy, fees, or policies of those services. FTR may earn a commission from NinjaTrader sign-ups made through our links. NinjaTrader® is a registered trademark of NinjaTrader Group, LLC, which is not affiliated with and does not endorse FTR.

14. Disclaimer of Warranties

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.

15. Limitation of Liability

To the fullest extent permitted by law, FTR, Jason Niehoff, and our team will not be liable for any trading losses or for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the 12 months before the claim arose.

16. Indemnification

You agree to indemnify and hold harmless FTR, Jason Niehoff, and our team from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your trading activity, your use of the Services, or your breach of these Terms.

17. Termination

You may stop using the Services at any time, but doing so does not entitle you to a refund or end any payment obligation. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination, including those on risk, intellectual property, limitation of liability, and indemnification, will survive.

18. Governing Law

These Terms are governed by the laws of the District of Columbia, without regard to its conflict of law rules. Any dispute will be resolved in the local or federal courts located in the District of Columbia, and you consent to their jurisdiction.

19. Changes to These Terms

We may update these Terms from time to time. The effective date above shows when they were last updated. Continued use of the Services after changes take effect means you accept the updated Terms.
