End User License Agreement

1. Agreement

Futures Trading Revolution is a business name of Fundamental Futures, a sole proprietorship owned and operated by Jason Niehoff ("FTR," "we," "us," or "our"). This End User License Agreement ("EULA") governs your use of FTR's digital content and software, including the FTR curriculum and course videos, the Daily Futures Playbook, call replays, templates, checklists, written materials, and FTR's NinjaTrader indicators and add-ons (together, the "Licensed Materials"). By purchasing, downloading, installing, or using the Licensed Materials, you agree to this EULA.

2. License Grant

Subject to this EULA and payment of all amounts due, FTR grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Licensed Materials for your own personal, non-commercial education and trading.

3. License Term

Your license to program content lasts for the access period of the product you purchased, unless the product page states otherwise. Your license to downloadable indicators continues until terminated under this EULA. Access may end if your program term ends, a payment fails, or you breach this EULA or our Terms of Service.

4. Restrictions

You may not, and may not allow anyone else to:

Share, resell, rent, lend, sublicense, or distribute the Licensed Materials or your login credentials.
Copy, download, screen-record, or reproduce course videos, call replays, or the Daily Futures Playbook, except as features of the platform allow for your personal use.
Post or publish any part of the Licensed Materials, including on social media, forums, Discord servers, or file-sharing sites.
Use the Licensed Materials to create a competing course, coaching program, signal service, or product.
Reverse engineer, decompile, disassemble, modify, or create derivative works of any indicator or software, except as permitted by law.
Remove or alter any copyright, trademark, or proprietary notices.
Install indicators on more machines or accounts than the product permits.

5. Ownership

The Licensed Materials are licensed, not sold. FTR and its licensors retain all right, title, and interest in them, including all intellectual property rights. All rights not expressly granted in this EULA are reserved.

6. Indicators and Third-Party Platforms

FTR's indicators are tools that calculate values or draw objects on your charts. They do not make trading decisions, generate trading signals, or guarantee any result, and you are responsible for verifying their settings, including any order-entry settings, before trading live. Indicators are designed for NinjaTrader and may require compatible versions, data, and settings. Updates to NinjaTrader or other third-party software may affect how they work. NinjaTrader® is a registered trademark of NinjaTrader Group, LLC, which is not affiliated with and does not endorse FTR. Third-party indicators referenced in our materials are licensed by their own developers under their own terms.

7. Educational Use and Risk

The Licensed Materials are for education only and are not financial advice. Futures trading involves substantial risk and is not suitable for every investor. You could lose all of, or more than, your initial investment. Only risk capital, meaning money you can afford to lose without affecting your financial security or lifestyle, should be used for trading. Past performance is not indicative of future results. Hypothetical and simulated results have inherent limitations, are prepared with the benefit of hindsight, and do not involve financial risk. Trades shown in lessons, classes, the Daily Futures Playbook, or any live session should be considered hypothetical and are for educational purposes only.

8. Disclaimer of Warranties

The Licensed Materials are provided "as is" and "as available," without warranties of any kind, including warranties that they will be error-free, uninterrupted, or compatible with your systems, to the fullest extent permitted by law.

9. Limitation of Liability

To the fullest extent permitted by law, FTR will not be liable for any trading losses, lost profits, data loss, or indirect, incidental, special, or consequential damages arising from the use of, or inability to use, the Licensed Materials. FTR's total liability under this EULA will not exceed the amount you paid for the Licensed Materials in the 12 months before the claim arose.

10. Termination

This license terminates automatically if you breach this EULA. On termination, you must stop using the Licensed Materials and delete any downloaded indicators and copies in your possession. Termination for breach does not entitle you to a refund.

11. Governing Law

This EULA is governed by the laws of the District of Columbia, without regard to its conflict of law rules.
